Bath, New York Probate Administration Attorney

Probate is a very emotional process for two reasons: everyone involved is still grieving the loss of a beloved friend or family member, and emotions can sometimes erupt over what is the "fair" way to distribute the assets.

I am David G. Wallace, and I have represented families in the Finger Lakes region for more than 30 years. I can help you smoothly navigate the probate process and avoid unnecessary conflicts. I can also represent you if you are currently involved in a conflict. To schedule an initial consultation, call 607-583-3062 or contact my office today.

Becoming the Executor or Administrator of an Estate

Every will names one trusted person (often a family member or trusted friend) to act as the "executor" of the estate. The executor's duty is to see to it that all debts are paid and all property is distributed according to the terms of the will. If an estate has no will, then an "administrator" must step forward and volunteer to perform those same duties.

However, the court will not recognize you as the executor or administrator of the estate until you first approach them and submit certain paperwork. In addition to helping executors and administrators become recognized by the probate court, I also assist with the process of distributing the estate.

Handling and Preventing Conflicts in Probate

With thorough estate planning, most litigation over wills, trusts or probate can be prevented. And if you visit a lawyer before the probate process begins, especially if you bring all the beneficiaries together to make sure that they are all being treated fairly, you can create a cooperative mindset that strengthens family relationships instead of making them antagonistic.

If your loved one has recently passed away, I can provide reliable, personalized and experienced legal service. Schedule an initial consultation today by calling 607-583-3062 or by contacting my office online.
